FEMA amp; BANKING : Where plaintiff had purchased schedule property 3 months prior to creation of mortgage by owner of property in respect of which bank had initiated recovery proceedings, said mortgage would not bound plaintiff and therefore, suit filed by plaintiff against bank for permanent injunction not to disturb their possession over schedule property was rightly allowed by Trial Court
